1. Acceptance of Terms

By accessing and using this website and Lightning Lead services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Lightning Lead provides marketing and business technology solutions including:

  • AI-powered phone answering and call handling (Always Answer)
  • Custom mobile app development and hosting
  • Custom website design and hosting
  • Online presence audits and reporting
  • Paid advertising management (Meta & Google)
  • Social media management and content creation

3. Account Eligibility

  • You must be at least 18 years old to use our services
  • You must be a legitimate business operating in the United States
  • You are responsible for all activities conducted under your account
  • You agree not to use our services for illegal or prohibited activities

4. Pricing and Payment

  • All prices are in USD and exclude applicable taxes unless stated otherwise
  • Setup fees and monthly service fees are due as specified in your service agreement
  • Payments are processed through Stripe and recurring charges will bill automatically
  • You are responsible for providing accurate billing information
  • Failure to pay may result in service suspension or termination

5. Billing and Cancellation

Monthly Services: Billed monthly on the same day of the month. You may cancel anytime with written notice.

Setup Fees: Non-refundable. Design and development fees are earned upon completion.

Early Termination: Cancellation does not entitle you to a refund of paid fees. Remaining contract obligations remain due.

6. Service Level & Uptime

We strive to maintain 99% uptime for our services. However, we do not guarantee uninterrupted service. We are not liable for:

  • Interruptions due to third-party providers (GoHighLevel, Supabase, etc.)
  • Scheduled maintenance (announced with 48 hours' notice when possible)
  • Network issues beyond our control
  • Client-caused downtime or misconfiguration

7. Data and Compliance

  • A2P SMS: All SMS communications comply with 10DLC regulations and industry standards
  • Do Not Call/Do Not Text: You are responsible for maintaining compliant lists and honoring opt-out requests
  • TCPA Compliance: You warrant that all phone numbers and messaging practices comply with applicable law
  • Data Retention: We retain service data per industry standards and applicable laws

8. Intellectual Property

All content created specifically for your business (custom apps, websites, ads) remains your property. You grant Lightning Lead a license to use your data to provide services and improve our platform.

Our proprietary technology, processes, and methodologies remain our intellectual property.

9. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIGHTNING LEAD SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Lost revenue, lost profits, or lost business opportunities
  • Damages from third-party actions or third-party platform failures

Our total liability for any claim shall not exceed the total fees paid in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Lightning Lead from any claims arising from:

  • Your use of our services in violation of applicable law
  • Your violation of third-party rights
  • TCPA or compliance violations
  • Content or data you provide to us

11. Warranties and Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • Services will meet your specific needs
  • Services will be error-free or uninterrupted
  • Any defects will be corrected
  • Your use will result in specific business outcomes

12. Termination

We may terminate your account and services immediately, without notice, if you:

  • Violate these Terms & Conditions
  • Engage in illegal activity
  • Violate TCPA, A2P, or compliance regulations
  • Fail to pay fees after 30 days notice
  • Harass our staff or violate our community standards

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes become effective upon posting to this page. Continued use of our services constitutes acceptance of modified terms.

14. Governing Law

These Terms & Conditions are governed by the laws of the State of Michigan, without regard to its conflict of law provisions.
